1. About these terms
These Terms and Conditions apply to your use of www.agatahenderson.co.uk and to purchases made through the website.
The website is operated by Agata Henderson, trading as Agata Henderson Artist, referred to in these terms as “I”, “me” or “my”.

Please read these terms carefully before placing an order. By placing an order, you confirm that you accept these terms. Nothing in these terms affects your statutory rights as a consumer.
2. About my artwork
My work includes handmade glass art, stained glass, fused glass, mosaic, jewellery, decorative objects and other original artworks.
Many pieces are individually handmade and one of a kind. Small variations, tool marks, bubbles, textures, irregular edges and differences in colour are natural characteristics of handmade glass and form part of the artwork. They are not normally considered faults.
Measurements are approximate. I make every reasonable effort to display colours and details accurately, but the appearance of an artwork may vary depending on lighting, photography and the screen or device on which it is viewed.
Please read the individual product description carefully before ordering.
3. Glass safety and care
Glass is fragile and must be handled, displayed and installed with appropriate care.
Unless a product description specifically states otherwise, artworks are intended for decorative use only. They are not toys and should be kept away from young children and pets.
Customers are responsible for ensuring that:
-
artworks are displayed on a stable and suitable surface;
-
hanging or suspended pieces are installed using appropriate fixings;
-
items are not exposed to unsuitable heat, impact or extreme temperature changes; and
-
outdoor pieces are installed and maintained in accordance with any care instructions supplied.
I am not responsible for damage caused by incorrect handling, installation, storage, cleaning, display or use contrary to the supplied instructions.
This does not exclude responsibility for an item that was faulty, unsafe or not as described when supplied.
4. Prices
All prices are shown in pounds sterling.
Prices include VAT where applicable. Delivery charges, and any other applicable charges, will be displayed before you complete your purchase.
I may change prices at any time, but a change will not affect an order that I have already accepted.
If a product is accidentally listed with an incorrect price or description, I may contact you to correct the error before accepting the order. You may then confirm the order at the corrected price or cancel it for a full refund.
5. Placing an order
Placing an order through the website is an offer to purchase the selected item.
After you place an order, you should receive an automatic acknowledgement. This acknowledgement confirms that the order has been received but does not necessarily mean that it has been accepted.
A contract is formed when I send confirmation that the order has been accepted or dispatched.
I reserve the right to decline or cancel an order before dispatch if:

the item is no longer available;
-
payment has not been authorised;
-
there has been an error in the price or description;
-
I cannot deliver to the address provided;
-
I reasonably suspect fraudulent or unauthorised activity; or
-
the order breaches these terms.
If payment has already been taken for an order I cannot fulfil, the payment will be refunded in full.
6. One-of-a-kind artwork and availability
All artworks are unique. Adding an item to your basket does not reserve it.
Although I take reasonable steps to keep stock information accurate, an artwork may occasionally be sold through another exhibition, gallery or sales channel before the website is updated.
If an item is no longer available after you place an order, I will contact you and issue a full refund. I may suggest an alternative, but you will not be required to accept it.
7. Payment
Payment must be made using one of the methods offered at checkout.
You confirm that you are authorised to use the selected payment method and that the billing information you provide is accurate.
The artwork remains my property until payment has been received in full.
8. Delivery
Available delivery methods, estimated times and charges will be shown at checkout or agreed with you before the order is accepted.
I will normally dispatch available items within the timeframe stated on the product page. Commissioned, personalised and made-to-order pieces will have separate estimated completion and delivery times.
Unless a different timeframe has been agreed, goods will be delivered without undue delay and no later than 30 days after the contract is formed.
Delivery dates are estimates unless I have expressly agreed that a particular date is essential.
You are responsible for providing a complete and accurate delivery address. Additional delivery costs caused by an incorrect address or an uncollected parcel may be charged to you where permitted by law.
Responsibility for the artwork passes to you when it is delivered to you, or to a person identified by you to receive it. If you independently appoint a carrier that I did not offer, responsibility may pass to you when the artwork is handed to that carrier.
9. International orders
I do not offer international delivery as standard. Where international delivery is offered, customers are responsible for checking whether the artwork may lawfully be imported into the destination country.
The recipient may have to pay local customs duties, import taxes or handling charges. Unless expressly stated otherwise at checkout, these charges are not included in the product or delivery price and are the customer’s responsibility.
International delivery may be delayed by customs procedures outside my control.
10. Cancelling an online order
If you are a consumer purchasing an eligible item online, you normally have the right to cancel your order without giving a reason.
The cancellation period begins when the contract is formed and ends 14 days after the day on which you, or a person nominated by you, receives the goods.
For an order delivered in separate parcels, the period ends 14 days after you receive the final parcel.
To cancel, you must clearly inform me of your decision before the cancellation period expires. You may contact me by email or use the cancellation form at the end of these terms.
After notifying me, you must return the item within a further 14 days.
11. Exceptions to cancellation rights
The statutory right to cancel does not normally apply to:
-
bespoke or commissioned artwork made to your specifications;
-
clearly personalised items;
-
items altered at your request; or
-
sealed goods that are not suitable for return for health-protection or hygiene reasons, including sealed earrings, where the seal has been broken after delivery.
This exception does not affect your rights if an item is faulty, damaged, unsafe or not as described.
Work on a commissioned or personalised piece may begin after the order has been accepted. Once work has begun, cancellation may not be possible where the item is being made to your specifications.
12. Returning an unwanted item
Before returning an item, please contact me at [INSERT CUSTOMER-SERVICE EMAIL] for return instructions.
Unless the item is faulty, damaged or not as described:
-
you are responsible for the direct cost of returning it;
-
the item must be securely packaged, preferably using its original protective packaging;
-
you should use a tracked and appropriately insured delivery service; and
-
the item should be returned to 20 Townholm Crescent, London W7 2NA.
Because glass is fragile, you must take reasonable care when handling and packaging it. You may be responsible for any reduction in value caused by handling beyond what would reasonably be permitted when examining the item.
13. Refunds following cancellation
If you validly cancel an eligible order, I will refund:
-
the price paid for the returned item; and
-
the cost of the least expensive standard delivery method offered when the order was placed.
Additional costs resulting from your choice of an enhanced or express delivery service will not normally be refunded.
The refund will be made within 14 days of the earliest of:
-
the day I receive the returned item;
-
the day you provide evidence that you have returned it; or
-
where no goods were supplied, the day I am informed of your cancellation.
Refunds will normally be made using the original payment method unless otherwise agreed.
14. Damaged, faulty or incorrectly supplied items
Please inspect your order as soon as reasonably possible after delivery.
If an item arrives damaged, faulty, unsafe or materially different from its description, contact me promptly at [INSERT CUSTOMER-SERVICE EMAIL]. Please retain the item and all packaging and, where possible, provide photographs of:
-
the artwork and the damage;
-
the internal packaging;
-
the external parcel; and
-
the delivery label.
These photographs help me investigate damage with the delivery provider, but providing photographs does not remove your statutory rights.
Depending on the circumstances and your legal rights, I may offer a repair, replacement, price reduction or refund. As many artworks are unique, an identical replacement may not be possible.
I am responsible for ensuring that goods reach you safely when I arrange delivery. I will not require you to pursue the courier directly as a condition of receiving an appropriate remedy.
15. Repairs
Any repair or restoration service is subject to a separate assessment and quotation.
Although I will take reasonable care, repairs to handmade or previously damaged glass cannot always be completely invisible. Kiln firing and restoration can produce variations, and an exact match may not always be possible.
The likely result, price and any significant risks will be explained before paid repair work begins.
16. Commissions and personalised artwork
Commissioned work may be subject to additional written terms covering the design, dimensions, materials, price, deposit, payment stages, completion estimate and number of revisions.
Colours, textures and kiln-fired results can vary. Digital drawings, samples and photographs are guides rather than guarantees of an exact result, unless a particular feature has been expressly agreed in writing.
Deposits and payments for commissioned work may be non-refundable once design, material purchasing or production has begun, except where required by law or where I fail to provide the agreed work.
17. Intellectual property
All artwork, designs, photographs, text, graphics, logos and other content appearing on this website are owned by me or used with permission and are protected by copyright and other intellectual-property laws.
Purchasing an original artwork transfers ownership of the physical item only. It does not transfer copyright or reproduction rights.
You must not reproduce, manufacture, copy, publish, distribute, commercially exploit or create derivative products from my artwork, designs or website content without prior written permission.
You may share links to the website and images of artwork for personal, non-commercial purposes, provided that the images are not altered and Agata Henderson is clearly credited as the artist.
18. Website availability and external links
I try to keep the website accurate, secure and available, but I cannot guarantee uninterrupted access or that all content will always be free from errors.
The website may contain links to third-party websites. These links are provided for convenience and do not mean that I control or endorse those websites. I am not responsible for third-party content, security, availability or privacy practices.
19. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation; or
-
breach of your statutory consumer rights.
If you are purchasing as a consumer, I am responsible for foreseeable loss or damage caused by my breach of these terms or failure to use reasonable care and skill.
I am not responsible for loss or damage that was not reasonably foreseeable, or for business losses arising from a consumer purchase, including loss of profit, revenue, opportunity or business interruption.
20. Events outside my reasonable control
I am not responsible for delays or failure caused by events outside my reasonable control, including severe weather, fire, flood, transport disruption, customs delays, industrial action, illness, failures of utilities or communications networks, or disruption affecting suppliers.
If such an event materially delays an order, I will contact you and take reasonable steps to minimise the effect. If there is a substantial delay, you may have the right to cancel and receive a refund for goods not supplied.
21. Privacy and cookies
Personal information is handled in accordance with the website’s Privacy Policy.
The website also uses cookies and similar technologies as explained in the Cookie Policy.
22. Changes to these terms
I may update these terms occasionally. The terms applying to an order will be those published on the website when the order is placed.
The date at the top of this page shows when the terms were last updated.
23. If part of these terms is invalid
If any provision is found to be unlawful or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary. The remaining provisions will continue to apply.
24. No waiver
If I do not immediately enforce a right under these terms, this does not mean that I have waived that right.
25. Governing law and disputes
These terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you retain any mandatory protections provided by the laws of your country of residence and may bring proceedings in the courts available to you under applicable consumer law.
If a problem arises, please contact me first so that I have an opportunity to resolve it.
